My girlfriend is pregnant, will I get in more-than-usual legal trouble if I punch her in the stomach?

This isn't an inflammatory question, it is a very good one that illustrates how contradictory the law is about abortion. While we don't recognize fetus' as humans, if you punch a pregnant woman in the stomach, you will receive greater prosecution than if she were not pregnant. WTF?
